spa:El presente documento se propone estudiar el funcionamiento de la movilidad de tierras privadas en Manizales entre 1850 y 1897 por medio de registros de compraventa. La hipótesis que se sostiene es que dicho proceso funcionó de manera libre de los atavíos estatales, pero creció gracias a la libertad concedida por la seguridad jurídica a la propiedad privada que otorgó el mismo Estado. De esta manera, se muestra que su funcionamiento no obedeció exclusivamente a las leyes de oferta y demanda, sino también a variables de tipo sociológico, topográfico y de acceso a recursos. Las fuentes utilizadas son 6.145 protocolos de compra- venta de tierras que reposan en la notaría primera de Manizales, los códigos civiles, el diario oficial y los códigos de comercio y fiscal. En un primer momento, se muestran los debates teóricos e historiográficos en torno a la problemática de la formación de los mercados de la tierra; posteriormente, se estudia el derecho de propiedad y la normatividad vigente que lo regulaba para poder entender el papel del registro notarial de compraventa; por último, se indaga acerca de las particularidades de la circulación de la tierra en Manizales. De este modo se analizará el concepto de propiedad y los modos de adquirirla, los títulos que la definían y su formalización, la dinámica de las transacciones y su funcionalidad. eng:This document aims to study the functioning of private land mobility in Manizales
between 1880 and 1897 through sale and purchase records. The hypothesis is that the
process functioned free of state restrictions but grew thanks to the freedom granted by the
legal security of private property granted by the state itself. In this way, it is shown that
its operation did not obey exclusively the laws of supply and demand, but also
sociological, topographical, and resource access variables. The sources used are 6,145
land sale-purchase protocols in the first Manizales notary's office, the civil codes, the
official gazette, and the commercial and tax codes. First, the theoretical and
historiographical debates on the problem of the formation of land markets are shown;
then, the right to property and the current regulations that governed it are studied in order
to understand the role of the notarial registry of sale and purchase; finally, the
particularities of the circulation of land in Manizales are investigated. In this way, the
concept of property and the ways of acquiring it, the titles that defined it and its
formalization, the dynamics of the transactions, and their functionality will be analyzed.
