Control fiscal posterior, concomitante y preventivo. ¿Se supera el temor al control previo y la coadministración?

spa:La historia del Control Fiscal desde la época de la República, ha mostrado que los procesos de
modernización de la administración pública colombiana, el crecimiento del Estado y las nuevas
formas de contratación y ejecución de los recursos públicos, ameritan la vigilancia de la gestión
fiscal y el ejercicio del control fiscal de manera integral, y no únicamente en forma posterior y
selectiva. Así mismo, debe empoderarse de una efectiva autonomía e independencia a los
órganos de control fiscal.
La autonomía e independencia y el ejercicio del control, mediante la actuación preventiva y
posterior, en tiempo real y permanente sobre los recursos públicos, se ajusta a la cláusula general
de competencia establecida en el artículo 119 constitucional, sobre vigilancia de la gestión y los
resultados de la administración por la Contraloría, siendo consonante con los fines esenciales del
Estado, descritos en el artículo 2 de la Constitución, y con el principio de separación de poderes
y de colaboración armónica entre entidades públicas.
Aunque la Corte Constitucional en Sentencia C-103 de 2015 declaró inexequible la función de
advertencia de la Contraloría que prevenía al gestor fiscal, hechos u operaciones en ejecución
susceptibles de generar graves riesgos al patrimonio público, por ser un control previo y
coadministración, la nueva estructura del control fiscal establecida en el Acto Legislativo 04 de
2019, mediante el control concomitante-preventivo y posterior-selectivo, le apuesta a la
protección integral de los recursos públicos y materializa la sinergia del control fiscal con el
Estado social de derecho y los principios fundantes de la Constitución Política.
Con todo, si la ratio decidendi de la Sentencia C-140 de 2020 que declaró ajustada a la
Constitución el Acto Legislativo 04 de 2019, aplicando el principio de interpretación conforme y
el desarrollo jurisprudencial que, sobre la vigilancia y el control fiscal ha realizado la Corte, se

hubieran aplicado en la Sentencia C-103 de 2015, se habría evitado todo el trámite legislativo de
reforma constitucional para revivir la función preventiva de la Contraloría, lo que refleja un caso
más de la costumbre reformista del sistema jurídico colombiano. eng:The history of Fiscal Control since the time of the Republic, has shown that the processes of

Although the Constitutional Court in Sentence C-103 of 2015 declared unenforceable the
Warning Function of the Comptroller's Office that prevented the fiscal manager, facts or
operations in execution that could generate serious risks to the public patrimony, due to being a
prior control and co-administration, the new Structure of Fiscal Control established in
Legislative Act 04 of 2019 through concomitant-preventive and subsequent-selective control,
bets on the comprehensive protection of public resources and materializes the synergy of fiscal
control with the Social State of Law and the founding principles of the National Constitution.
However, if the ratio decidendi of Sentence C-140 of 2020 that declared Legislative Act 04 of
2019 adjusted to the Constitution, applying the principle of compliant interpretation and the
jurisprudential development that, on fiscal surveillance and control, has carried out the Court,

had they been applied in Sentence C-103-2015, the entire legislative process of constitutional
reform would have been avoided to revive the preventive function of the Comptroller's Office,
which reflects one more case of the reformist custom of the Colombian legal system.
