La garantía de derechos a la discapacidad es una condición transversal e inherente a los seres humanos donde es necesario que tanto instituciones de la sociedad civil como otras organizaciones y el Estado tomen acciones para determinar su cumplimiento, ya que, tanto la enfermedad como la diferenciación corporal son parte de la condición humana, por ende, cualquier persona puede adquirir una condición diferencial. En este sentido, la Convención sobre los Derechos de las Personas con Discapacidad fue adoptada por la Asamblea General de Naciones Unidas el 13 de diciembre de 2006, y tiene como objetivo promover, proteger y garantizar el goce pleno de todos los derechos humanos.
Este hito, construye una nueva visión de la discapacidad al pasar de ser un tema de bienestar social a una prioridad que reconoce las limitaciones que promueven los juicios y estereotipos de la sociedad al pleno goce de sus facultades, tanto en materia de derechos como en desarrollo social (Palacio, 2014). Además, constituye un nuevo enfoque al pensar en la discapacidad desde la óptica de que, una situación que puede afectar a cualquier ser humano a lo largo de su vida, lo cual pone en juego la relación de factores ambientales y sociales que pueden impactar su calidad de vida.
El cambio de perspectiva es importante debido a que se cuestiona el papel del modelo rehabilitador, que implica transformar a la persona con discapacidad para que esta sea “funcional a la sociedad”, a un modelo social, que ve como prioridad la necesidad de concientizar a la sociedad para que esta genere los mecanismos para que las personas con discapacidad gocen de sus derechos fundamentales (Maldonado, 2013). Este enfoque, al trasladar a la discapacidad como parte de la condición humana, regresa el carácter humano de las personas y las pone como parte de la agenda política y social de los gobiernos nacionales.
Parte del reconocimiento de la discapacidad como problema social pone sobre la agenda una serie de problemáticas acerca de la relación de cuidado que estas personas tienen derecho a recibir y las responsabilidades y las limitaciones que tiene el Estado para garantizar la inclusión efectiva de la población. Furthermore, it constitutes a new approach when thinking about disability from the perspective that it is a situation that can affect any human being throughout their life, which brings into play the relationship of environmental and social factors that can impact their quality. of life.
The change in perspective is important because it questions the role of the rehabilitative model, which implies transforming the person with disabilities so that they are “functional to society”, to a social model, which sees as a priority the need to raise awareness among society so that it generates the mechanisms for people with disabilities to enjoy their fundamental rights (Maldonado, 2013). This approach, by transferring disability as part of the human condition, returns the human character of people and places them as part of the political and social agenda of national governments.
Part of the recognition of disability as a social problem puts on the agenda a series of problems about the care relationship that these people have the right to receive and the responsibilities and limitations that the State has to guarantee the effective inclusion of the population.
