spa: Acercarse al debate sobre la justicia territorial es prescindir de los modelos uniformes que privilegian determinada forma de ordenamiento territorial, por tanto, en dicho escenario se condensan multiplicidad de tensiones y contradicciones que obligan a replantear lo que se
comprende por derecho al territorio. En el marco de tal consideración, los actores sociales terminan evocando una determinada reivindicación, verbigracia la función que individual o socialmente es asignada, o las figuras de protección jurídica o consuetudinaria construidas
sobre la tierra y el territorio, lo que va permitiendo decantar uno u otro modelo en el que se
pondera la propiedad privada, la reforma agraria, el medio ambiente o la restitución de tierras a las víctimas del conflicto armado -siempre de manera excluyente-, pues continuamente habrán de valorarse criterios cuyos intereses entran en pugna con los demás. Por lo tanto, la concepción del derecho en una perspectiva territorial es una apuesta que permite que el campesinado tenga herramientas democráticas de participación en busca de reivindicación de sus derechos. Con
ello, como antecedente se estudiará el caso concreto de Samaná, municipio del oriente de Caldas que fue afectado con ocasión al conflicto armado y ejemplifica tan solo uno de los múltiples escenarios en los que el derecho en perspectiva territorial implica ser evaluado. eng: To approach the debate on territorial justice is to dispense with the uniform models that privilege a certain form of territorial ordering, therefore, in this scenario it is a condensed multiplicity of tensions and contradictions that force to rethink what is understood by the right to
territory. In the framework of such consideration, either the social actors that end up evoking a claim, the function that is individually or socially assigned, or the legal or customary protection figures built on the land and territory, allow one or the other to be decanted. model in which
private property, agrarian reform, the environment where the restitution of land to the victims of the armed conflict will be established -always in an exclusive way-, since criteria whose interests conflict with others will have to be continuously evaluated. Therefore, the conception of the right
from a social perspective within the territory is a bet that allows the peasantry to have democratic tools of participation in search of vindication of their rights. With this, as background it will
study the specific case of Samaná, a municipality in eastern Caldas that had a serious impact on the territory due to the armed conflict and exemplifies only one of the multiple scenarios inwhich the right from a territorial perspective implies being evaluated, in order to balance the importance of the territory in the construction and exercise of the right that arises in the discussion of the scene of the armed conflict.
